The decision is contested because there are doubts as to the application of the rules used.
The Spanish Data Protection Agency (AEPD) has fined a citizen 10,000 euros for spreading screenshots of conversations and intimate photos of a woman without her consent on her WhatsApp status. The ruling punishes conduct that is illegal but which many perceive as normal. In this case, the RGPD is applied directly to individuals, a position that generates debate because, according to many experts, the rule is intended to apply to companies and not to individuals.
We must bear in mind that personal data of third parties cannot be disseminated without their consent as this constitutes an infringement of the RGPD and although the resolution of the AEPD has been controversial, this is not the first time that individuals have been sanctioned for disseminating personal data of third parties. Without doubt, the sanction is a warning to all those who disseminate third party information without their consent.
